Terms and conditions for using DeskCRM as a cloud-based CRM and business management platform

These Terms of Service govern access to DeskCRM, including our website, hosted SaaS application, customer management tools, support services, and related software features. By registering for, accessing, or using DeskCRM, you agree to these terms.

Acceptance of Terms

By accessing DeskCRM, creating an account, starting a trial, purchasing a subscription, or using any part of the service, you confirm that you have read, understood, and agreed to these Terms of Service. If you are using the service on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these terms.

Scope of the Service

DeskCRM is provided as software-as-a-service and may include CRM records, lead management, communication tracking, reminders, project coordination, billing support, reporting, support management, and related business workflow tools. Features may change from time to time as we improve the platform, introduce upgrades, or retire outdated functionality.

Accounts and Access Control

You must provide accurate registration and billing information and keep it updated. You are responsible for maintaining the confidentiality of login credentials and for all activity under your account, including activity by employees, contractors, or invited users. You must notify DeskCRM promptly if you become aware of unauthorized account use or a security incident.

Subscriptions, Fees, and Renewals

Paid access to DeskCRM is offered on a subscription basis. Fees, billing cycles, plan limits, and renewal terms are governed by the commercial plan selected by the customer. Unless otherwise agreed in writing, subscription fees are due in advance, non-refundable except where required by applicable law, and may result in suspension or downgrade if payment is overdue.

Customer Data and Usage Rights

You retain ownership of the data, documents, customer records, and business information you upload to DeskCRM. By using the service, you grant DeskCRM the limited rights required to host, process, transmit, back up, secure, and display that data solely for the purpose of operating and supporting the platform. You are responsible for ensuring that you have the lawful right to collect, use, and upload the information stored in your account.

Acceptable Use and Restrictions

You may not use DeskCRM to violate laws, infringe intellectual property rights, transmit harmful code, interfere with service performance, attempt unauthorized access, scrape the platform, or misuse the system in a manner that could harm DeskCRM, other customers, or third parties. We may investigate suspected misuse and take appropriate action, including suspension or termination.

Service continuity, integrations, privacy, and platform ownership are handled under the following legal terms

Availability, Support, and Service Changes

DeskCRM works to maintain stable platform access, but uninterrupted availability is not guaranteed. Maintenance, upgrades, emergency security work, internet failures, third-party outages, and force majeure events may affect access or performance. We may update the service, modify features, change technical requirements, or release enhancements as part of normal SaaS operations.

Third-Party Services and Integrations

DeskCRM may work with third-party tools, gateways, messaging services, or integrations. Your use of those third-party services may be subject to separate terms and privacy policies. DeskCRM is not responsible for the availability, functionality, or legal compliance of third-party products that are not owned or directly controlled by us.

Intellectual Property

DeskCRM and its related software, design, content, trademarks, workflows, documentation, and platform elements remain the property of DeskCRM or its licensors. Except for the limited right to use the service during an active subscription or permitted trial period, no ownership or transfer of intellectual property is granted to the customer.

Privacy and Confidentiality

We handle personal information and account data in accordance with our Privacy Policy and our internal operational safeguards. Each party agrees to protect non-public business, technical, and customer information shared in connection with the service and to use that information only as necessary for the permitted business relationship.

Suspension and Termination

DeskCRM may suspend or terminate access if you breach these terms, fail to pay applicable fees, create security risks, misuse the platform, or use the service unlawfully. You may stop using the service at any time, subject to any active subscription commitments. Following termination, access to the service may be removed and data retention or deletion may be handled according to your plan, our policies, and applicable law.

Disclaimers and Limitation of Liability

DeskCRM is provided on an "as is" and "as available" basis to the maximum extent permitted by law. Except as expressly stated in a written agreement, we disclaim implied warranties including merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by law, DeskCRM will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, goodwill, or data arising from use of the service.

Indemnity and Changes to Terms

You agree to defend, indemnify, and hold harmless DeskCRM, its affiliates, directors, employees, and service providers from claims arising from misuse of the service, violation of these terms, infringement of third-party rights, or unlawful handling of customer data. We may update these Terms of Service from time to time, and continued use after the effective date constitutes acceptance of the revised terms.
